Common Causes of Rear-End Collisions

  • Distracted driving. This can include adjusting the stereo, inputting GPS coordinates, talking on the phone, texting, grooming, or a variety of other activities that take your eyes away from the road. A driver might think it’s harmless to take their eyes off the road for a quick second, but they’re wrong. In those brief moments you’re sending a text or putting on your make-up you can cause a rear-end collision or other serious accident. 
  • Tailgating. This is when a driver aggressively follows a vehicle too closely. Under Utah law, a driver must be “reasonable and prudent” when following a vehicle. You should maintain at least a 2 second following distance from the vehicle in front of you. This following distance needs to be increased depending on speed, weather, and road conditions. Tailgating is a common cause of rear-end collisions. 
  • Speeding. A driver is speeding if they are driving faster than the posted speed limit. You’re also speeding if you’re driving too fast for road conditions. Speeding increases the distance needed to stop a vehicle. If a driver is speeding and the driver in front of them stops suddenly, this can lead to a rear-end collision or even a multi-car pile up.

     

    Reasons Why the Driver in Back May Not Be Liable

    The following are some circumstances where the lead driver may be responsible for causing the rear-end collision:

    • The driver in front reversed suddenly-backing into the vehicle behind it
    • A vehicle was stopped in the road
    • The vehicle in front did not have functioning brake lights
    • There were multiple vehicles involved in the accident, and one vehicle pushed others forward
    • The vehicle malfunctioned and prevented the driver from stopping. In this case, the vehicle manufacturer could be found liable. 

    What Evidence Should I Gather at the Scene?

    After you are in a rear-end accident your first concern should be to seek needed medical attention. Call the police and make sure that a police report is taken. After you make sure that everyone’s injuries are attended to, start to gather as much evidence as possible to prove who is negligent in the accident. The more evidence that you gather, the better chance you have of obtaining the maximum compensation possible for your injuries and damages.

    Almost everyone these days has a smartphone with a camera. This can be very helpful after an accident. Take as many pictures of the scene of the accident as possible.
