Statute of limitations: There is a statute of limitations of two years on personal injury claims – meaning you must file a personal injury lawsuit within two years from the date of the injury. If it is a claim against the Texas government, that time gets cut to half a year – the claim generally must be filed within 6 months of the incident.

Special damages are the opposite of general damages. They refer to the economic, or financial, losses that stem from the defendant’s act of negligence or wrongdoing. Special damages are the plaintiff’s out-of-pocket expenses relating to the incident, including:

• Lost wages and lost capacity to earn
• Property damage repair or replacement costs
A jury will listen to a plaintiff’s case and calculate general damages based on the severity of the injury and the impact it will have on the victim’s life, often using a multiplier of one to five to decide how much the victim deserves. Special damages, on the other hand, are easier to calculate because they refer to an exact dollar amount the plaintiff has and will spend.
